The General Assembly has made several changes to the laws which control and affect community associations in Virginia. These changes became effective July 1, 2007. In September 2007, the Virginia Supreme Court adopted a new rule regarding the rights of tree owners on adjoining properties in circumstances where intruding trees could create problems or nuisances. This case, Fancher v. Fagella, altered a 70 year-old precedent and changes the old rules regarding the rights of tree owners and their neighbors.
