Community Association Collections

Attorneys with experience handling delinquencies

When community association members fall behind on the payment of assessments and other fees, prompt action must be taken. Chadwick, Washington, Moriarty, Elmore & Bunn P.C. appreciates that assessments are vital to an association’s financial health. Whether the delinquent payments are HOA assessments, condominium association dues or cooperative carrying charges, Chadwick Washington knows how to effectively handle collections.

Addressing collections with efficiency and purpose

Because delinquency is such a common problem for associations, Chadwick Washington employs an extensive team of paralegals who are devoted to assessment collections. The firm will initiate legal proceedings as soon as it becomes evident that an association member will not be brought to compliance voluntarily. The firm handles all phases of the collections process:

  • Sending notices of intent to file lien
  • Filing assessment liens
  • Securing personal judgments against debtors
  • Foreclosures
  • Post-judgment execution remedies
    • Garnishments of wages and bank accounts
    • Property levies

The firm also has extensive experience representing associations as creditors in member bankruptcy proceedings. Chadwick Washington helps your association maintain collection efforts by filing proofs of claims and challenging ineffective Chapter 13 repayment plans.

Proposing methods to reduce delinquency

Chadwick Washington also provides advice regarding other methods to decrease your community’s delinquency rate, such as suspending owner privileges to use association facilities, establishing late fees and other means to deter delinquencies. The firm believes in exploring and implementing strategies that encourage the community members to pay on time, avoiding the need for collections actions whenever possible.  We will also provide advice about the difficult cases, so the association is pursuing delinquencies in the most efficient way possible.

Cost-effective collections – no minimum fee for court appearances

Chadwick Washington understands that collections can be a financial burden, and the firm strives to provide service in a cost-effective manner. Many tasks are handled on a competitive flat fee basis, such as preparing liens and lawsuits. Other collections matters are billed hourly. For court appearances, our lawyers spread billable time equitably over all matters in court on a given day to ensure the fairest billable charge. Unlike some firms, we have no minimum fee for court appearances.

Detailed Status Reports with 24/7 Online Access

We will keep you apprised of our collection efforts with detailed status reports that allow the board and management to know all actions taken on individual cases.  With the firm’s new CW AccountView system, managers and association presidents are allowed online secure access to collection account information. CW AccountView allows clients and managers to access and print status reports, quickly send emails to the collections paralegal or attorney assigned to the accounts, and provide the firm with updated client contact information.  To become a registered user, managers and clients may call the firm or send an email to [email protected].
