As we previously reported, the Community Associations Institute filed a lawsuit in federal court to challenge the applicability of the Corporate Transparency Act to community associations nationwide. On October 11, the US District Court for the Eastern District of Virginia heard oral argument from CAI’s legal team at Gordon Reese, as well as Brendan Bunn and Ed Allock (representing individual associations in the case), where CAI sought a preliminary injunction to delay the January 1, 2025 deadline for associations to file volunteer director information in the FINCEN database.
Unfortunately, on October 24, the court issued an order denying the injunction, despite arguments made as to the negative effects of CTA on community association volunteerism. This does not mean the case is over, as CAI will likely appeal the decision to the 4th Circuit. In addition, the case is set to go through the normal process.
